TankPup Terms of Service

Effective date: October 15, 2026

These terms are an agreement between you and Forecourt Labs LLC, a New Hampshire limited liability company that operates TankPup ("TankPup", "we", "us"), for use of the TankPup apps, website and service (the "Service"). If you use the Service for a business, you agree on behalf of that business. If you don't agree, don't use the Service.

1. What TankPup does — and doesn't

TankPup connects over the internet to automatic tank gauge (ATG) consoles you add, shows their readings, keeps history, and can notify you about alarms.

TankPup is a convenience tool, not a safety, compliance or alarm-monitoring system. Readings and alerts can be delayed, incomplete or wrong — for example because of internet or console outages, console settings, polling schedules, or notification-delivery problems — and some console conditions may not be detected or described correctly. You remain fully responsible for:

• complying with all leak-detection, release-detection, recordkeeping and other requirements that apply to your tanks and lines (including EPA and state underground storage tank rules);
• responding to alarms shown on your consoles and equipment on site;
• maintaining your consoles' own alarm outputs, printers and any required monitoring.

Do not rely on TankPup as your only means of learning about alarms, leaks or other hazards.

2. Your account

• Give accurate information and keep it up to date.
• Keep your password confidential; you're responsible for activity under your account.
• You must be at least 18 and able to enter this agreement.
• One person per login; logins may not be shared. An organization may have several members, up to its plan's user limit (see section 4).
• The person who creates an organization is its owner. The owner manages the plan, billing and the organization's members, and is responsible for the people they invite. Ownership can be handed to another member through support.

3. Consoles you connect

You may only add consoles that you own or are authorized to access and operate, using credentials you're authorized to use. You give TankPup permission to connect to those consoles on your behalf, read their data, and — when you or your organization's members use them — send the commands for features like reports, line leak tests and Console Mode.

Line tests and Console Mode change console state. Starting or stopping a line leak test, or pressing keys in Console Mode, has the same effect as doing it at the console, including stopping dispensing on a line. Only use these features if you are qualified and authorized to operate that equipment. TankPup marks some commands as not yet verified on every console model; use them at your own risk.

4. Plans and billing

• Free plan: one ATG Console and one user, read-only, without push notifications or live features, and with less frequent updates.
• Paid plans add ATG Console capacity, more users, push notifications (alarms and warnings with their details, all-clear, offline and custom alerts), line tests, Watch live and Console Mode, as described at tankpup.com. Prices are shown before you buy.
• ATG Consoles: each plan includes a number of ATG Consoles, shown at tankpup.com. On a paid plan the owner can add a limited number beyond that for an additional monthly fee per console. The app shows the fee before the console is added; it is added to your subscription, prorated, and removed, prorated, when the console is deleted or when you move to a plan that includes it. Consoles beyond what your plan allows are paused, not deleted.
• Users: each plan includes a number of users (members of your organization), shown at tankpup.com. On a paid plan the owner can add users beyond that for an additional monthly fee per user. The app shows the fee before an invitation is sent; it is added to your subscription, prorated, when the person joins, and removed, prorated, when they leave or when you move to a plan that includes them.
• Free trial: each organization's first paid plan starts with a 14-day free trial. If you cancel before the trial ends, you won't be charged; otherwise billing starts when it ends.
• Paid plans are billed monthly in advance through our payment processor, Stripe, and renew automatically until cancelled. You can cancel at any time from Plan & billing at www.tankpup.com/plan; cancellation takes effect at the end of the current billing period, and we don't refund partial months.
• You can change plans at any time from the app; the difference is prorated. If you move to a plan with fewer ATG Consoles than you have, the extra consoles are paused (not deleted) until you upgrade or remove some.
• We may change prices with at least 30 days' notice; changes apply from your next billing period.
• Taxes may apply. If a payment fails, we may downgrade the account to the Free plan.
• Plans for more than 50 ATG Consoles, or a dedicated server, are arranged separately.

5. Acceptable use

Don't:

• use the Service to access equipment or networks you're not authorized to access, or to probe, scan or attack any system;
• interfere with the Service, bypass its limits or security, or overload it;
• resell or share access to the Service except as your plan allows;
• use the Service for anything unlawful.

We may suspend or limit accounts that put the Service, other users or third parties at risk.

6. Your data

You keep your rights to your data, including your console readings. You give us permission to store and process it to provide the Service, as described in our Privacy Policy. You can delete your account and its data at any time from the app.

7. Third-party equipment and services

TankPup is independent and is not affiliated with or endorsed by Veeder-Root, Franklin Fueling Systems or other equipment makers; their names are used only to describe compatibility. Features depend on how those consoles behave and may stop working if a manufacturer changes them. Push notifications rely on Apple, Google and Expo, and payments on our payment processor.

8. Changes and availability

We may change, add or remove features. We aim to keep the Service available but don't guarantee it will be uninterrupted or error-free. We'll give notice of material changes to these terms by email or in the app; continuing to use the Service after they take effect means you accept them.

9. Ending the agreement

You can stop using the Service and delete your account at any time. We may suspend or end your access if you breach these terms, if required by law, or if we discontinue the Service (in which case we'll give reasonable notice and refund any prepaid amount for the unused period).

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DON'T WARRANT THAT READINGS, ALARMS OR NOTIFICATIONS WILL BE ACCURATE, COMPLETE OR TIMELY.

11. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW: (a) WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST FUEL, ENVIRONMENTAL CLEANUP COSTS, FINES OR PENALTIES; AND (b) OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US$100.

12. Indemnity

You'll defend and indemnify us against claims arising from your use of the Service, the consoles and equipment you connect, or your breach of these terms or the law.

13. Law and disputes

These terms are governed by the laws of the State of New Hampshire, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Rockingham County, New Hampshire, and you and we consent to their jurisdiction.

14. General

These terms, with the Privacy Policy, are the whole agreement between us about the Service. If part is unenforceable, the rest still applies. You may not transfer these terms without our consent; we may transfer them with the business.
